Terms of service
These terms are the agreement between you and Lodo, s. r. o., the company behind Noiserun ("we", "us"). They apply when you use the Noiserun player (play.noiserun.com), our website (noiserun.com), a screen you pair at noiserun.com/pair, and anything you get through them. By using Noiserun, you agree to these terms.
If you use Noiserun for an organisation (Premium Business, or Spaces for a venue), the organisation's agreement with us is in our Business terms. You still use your own account under these terms.
The short version
- Free scenes play without an account. No ads.
- Premium and Premium Family are for personal use. Screens that guests, customers or a whole workplace see need Spaces.
- Card payments are handled by Paddle, our reseller. Paddle takes the payment, charges the tax and sends the invoice.
- You can cancel a subscription at any time. Scenes and packs you bought stay yours.
- A signed-in account plays on one device at a time, plus one paired screen.
- You can ask for a refund within 14 days of any payment. See our Refund policy.
- Your rights as a consumer always apply. Nothing in these terms takes them away.
1. Who we are
Lodo, s. r. o., Mikovíniho 19, 917 02 Trnava, Slovakia. Company ID 54 239 583, registered in the Commercial Register of the District Court Trnava, section Sro, file no. 50455/T. More details are in our Legal notice.
You can reach us at hello [at] noiserun.com or through the contact form. We usually reply within a few days.
2. What these terms cover
These terms, our Privacy policy and our Refund policy together make up our agreement with you. The privacy policy explains how we handle your data. It is not a contract you sign, but we stick to it.
When you pay by card, you also buy from Paddle under Paddle's own terms (section 9).
3. What Noiserun is
Noiserun plays gentle, endless soundscapes. Each one comes with a moving picture that matches what you hear. We call the picture and its sound together a scene. Scenes are grouped into packs.
Noiserun runs in a web browser on your phone, tablet, computer or TV. You can add it to your home screen like an app. You need a reasonably recent browser and an internet connection. Picture quality adapts to what your device can play smoothly.
4. Listening for free
You can listen without an account. Some scenes play in full for free; the others play as a short preview. The player shows which is which. We may change which scenes are free, how long previews last and what free listeners can do.
5. Your account
An account is optional. It keeps your Library and what you unlocked on every device where you sign in. You need it to buy, to redeem a code and to join a plan someone shares with you.
Signing in. There is no password. We send a one-time code and link to your e-mail address. Anyone who can read your e-mail can sign in to your account, so keep your e-mail account secure. Tell us right away if you think someone else used your account.
Age. You must be at least 16 to create an account or buy anything. If you are younger, a parent or guardian has to do it for you.
One person per account. Don't share your account with other people. To listen together with people close to you, use Premium Family (section 13).
Your Library is the list of scenes you saved. It belongs to your account and stays when a plan or subscription ends.
Deleting your account. You can delete your account in the app at any time. Deleting it removes your Library and everything you bought or unlocked on it; this can't be undone. Cancel any subscription before you delete your account, otherwise Paddle keeps charging it (section 10). We keep purchase records only because accounting law requires it (see our Privacy policy).
6. What you can get
- Premium – a subscription that unlocks every scene and every pack, including new packs on the day they come out, for as long as your subscription runs.
- Single scenes and packs – one-off purchases. A pack includes the scenes we add to that pack later.
- Premium Family – Premium for you and the people you share it with, up to the number of people shown with the plan, each with their own account and Library (section 13).
- Codes – gift or promo codes that unlock Premium, a plan, a pack or a scene (section 12).
- Through an organisation – Premium Business from your employer, school or another organisation, or the role of a manager of Spaces screens for a venue (section 14).
What each option includes, its price and how long it runs are shown before you pay. The price and terms shown at checkout are the ones that apply to your purchase.
7. Your licence and personal use
When you get access to a scene, we give you a personal, non-exclusive, non-transferable right to play it in Noiserun, for as long as you have access to it.
Personal use means:
- you play Noiserun on your own devices, at home, on the go or at your own desk,
- people who live with you or visit you at home may watch and listen with you.
Personal use does not include:
- playing Noiserun on a screen or through speakers for customers, guests, patients, visitors, students or a whole office – for example in a shop, café, waiting room, hotel, gym, reception or class. For that, your organisation needs Spaces (see our Business terms),
- recording, copying or downloading scenes or their sound, or using them in your own videos, streams, podcasts, broadcasts, apps or other products,
- selling, renting or sharing access to Noiserun, your account or codes for money.
If you'd like to use Noiserun in a way that isn't covered here, for example in a video or a stream, write to us first. We'll tell you whether it's possible and on what terms. Such use needs our written permission.
8. Devices and screens
One device at a time. When you are signed in, your account plays on one device at a time. If you start playing on another device, Noiserun asks whether to play there instead. The first device then stops.
One screen at a time. You can pair screens (a TV, computer or tablet) at noiserun.com/pair and play on one of them at a time. Your other paired screens wait on standby until you choose them. Screens follow the device that is playing. If another device of your account takes over, the screen goes on standby.
Each person in Premium Family or Premium Business has their own account, with their own device and screen.
9. Buying: Paddle is our reseller
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
This means that when you pay by card or another payment method in Noiserun:
- you buy from Paddle, which then lets us give you access,
- Paddle takes the payment, charges VAT or sales tax where it applies, and sends you the receipt or invoice,
- Paddle handles refunds, chargebacks and payment questions,
- the Paddle Buyer Terms and Paddle Refund Policy apply to the purchase itself,
- these terms apply to using Noiserun and to what we promise you about it.
Prices are shown before you pay. For consumers, the price includes VAT or sales tax where it applies. Paddle may show the price in your local currency.
Your order. You place the order by confirming the payment in the checkout. Paddle sends you a receipt. We also send you a purchase confirmation by e-mail with a purchase ID (like NR-K7QM-X4TB). Anyone with that ID can check the purchase at play.noiserun.com/receipt.
Access starts right away. Scenes, packs and Premium unlock on your account as soon as the payment goes through. In the checkout you are asked to agree to this. What that means for your right to withdraw is explained in our Refund policy.
Buying directly from us. Sometimes we sell directly, for example by bank transfer or invoice. Then Lodo, s. r. o. is the seller, we send you the confirmation and, where needed, the invoice, and the parts of our Refund policy about direct purchases apply.
10. Subscriptions
Renewal. Premium and Premium Family renew automatically at the end of each billing period (for example every month or every year), at the price shown when you subscribed, until you cancel. The checkout shows the billing period and the price before you pay.
Introductory prices. If an offer gives you a lower price for the first payments, the checkout shows how many payments it covers and the regular price after that.
Free trials. If an offer includes a free trial, the checkout shows how long it lasts and what you pay after it. You are charged when the trial ends unless you cancel before.
Cancelling. You can cancel at any time:
- through the link in Paddle's receipt e-mail, or at paddle.net,
- or by writing to us at hello [at] noiserun.com; we cancel it for you and confirm it by e-mail.
Cancelling stops the next payment. You keep Premium until the end of the period you already paid for. Scenes and packs you bought stay yours. For refunds, see our Refund policy.
Price changes. If we change the price of your subscription, we tell you by e-mail at least 30 days before the new price applies. If you don't want to continue, you can cancel before then. Where the law requires your agreement to a higher price, we ask for it.
Failed payments. If a renewal payment fails, Paddle may try again. If it still fails, your subscription may end or pause until it is paid.
11. Refunds and your right to withdraw
You can ask for a refund within 14 days of any payment. As a consumer in the EU (and some other countries), you also have a legal right to withdraw from a purchase within 14 days, with the limits the law sets for digital content and services. The details, and how to ask, are in our Refund policy.
12. Codes and gifts
- A code gives exactly what it says (for example Premium for a number of days, a plan, a pack or a scene), on the account where you redeem it.
- Each code can be used once per account. A single-use code works once in total. A promo code may have a limit on how many people can use it.
- Codes may have an expiry date. A code can't be used after it.
- If a code would add nothing (for example you already own the pack), it is not used up.
- Premium from a code runs for the stated time and doesn't renew. If you already have Premium, the extra time is added after it.
- Codes can't be exchanged for money, unless the law requires it.
- If a code was obtained or used by mistake, by fraud or against these terms, we may cancel it and remove what it gave. If you did nothing wrong, we give you a replacement where we can.
13. Premium Family
The person who gets Premium Family is its admin. The admin can add people by e-mail invitation or by showing them a code to enter in their account, up to the number of people shown with the plan, the admin included.
- Everyone in the plan gets Premium on their own account, with their own Library and their own device and screen.
- Premium Family is for people close to you – your family, the people you live with or close friends – for their personal use. It is not for colleagues, customers or an organisation; for those, see our Business terms.
- The admin sees the e-mail addresses and status of the people in the plan. Nobody in the plan sees what the others listen to.
- The admin can remove a person, and anyone can leave the plan in their account at any time.
- When the plan ends or a person leaves, Premium from the plan ends for them. Their account, Library and their own purchases stay theirs.
14. Noiserun through your organisation
If your employer, school or another organisation gives you Premium Business, its admins invite you by e-mail, or you join by signing in with an e-mail address from the organisation's domain.
- You use Noiserun on your own account, under these terms. The organisation's agreement with us decides how long its licence runs.
- The organisation sees your e-mail address, your role and when you were invited, joined or left. It never sees what you listen to, when or for how long. It sees only totals for groups of at least 5 people (see our Privacy policy).
- You can leave the organisation in your account at any time.
- When the licence ends or you leave, Premium from the organisation ends. Your account, Library and your own purchases stay yours.
If you manage Spaces screens for a venue, you act for that organisation. Spaces doesn't give you personal Premium.
15. Fair use
Please don't:
- break the law or anyone's rights when you use Noiserun,
- try to get around previews, locks, device limits or any other way we control access,
- copy, extract or reuse our scenes, sound, code or designs, or take apart our software, except where the law allows it,
- use bots, scrapers or other automated tools on Noiserun, or put an unreasonable load on our servers,
- try to break into accounts, screens or our systems, or interfere with their security,
- send spam or misuse invitations, contact forms or problem reports,
- give screens, plans or organisations names that are unlawful or offensive,
- resell or share access, accounts or codes for money.
If you break these rules, we may limit or suspend your account (section 21).
16. Our content
Noiserun, its scenes, sound, software, names and designs belong to Lodo, s. r. o. or to people who allowed us to use them. These terms don't transfer any of these rights to you, except the licence in section 7.
If you send us ideas or feedback, we may use them freely. We don't have to pay for them or name you.
17. Changes to Noiserun
Noiserun keeps changing. We add scenes and packs, improve them, fix problems and sometimes remove features. We do this for good reasons, such as improving the service, security, technical changes or the law, and at no extra cost to you.
Scenes you bought. We don't take away scenes or packs you bought, even when we stop offering them to new buyers. If we ever have to remove one (for example for a legal reason), we tell you and offer a fair replacement or a refund.
Changes that affect paid access. If a change makes it noticeably worse for you to use something you paid for, we tell you in advance by e-mail. You can then end the contract free of charge within 30 days and get back the part of the price for the time you can no longer use it. We don't need to do this for minor changes.
18. Availability
We work to keep Noiserun running smoothly, but we can't promise it will never be interrupted or free of errors. Sometimes we need to take it offline for maintenance or updates, and some browsers or devices may not support every feature. This doesn't limit your legal rights if something you paid for doesn't work as promised (section 19).
If we stop Noiserun. If we ever stop offering Noiserun, we tell you at least 90 days before. From that announcement we stop selling, and we stop charging subscriptions. We refund any subscription time you paid for but can't use. Scenes and packs you bought keep playing until the last day.
19. If something doesn't work
Everything you pay for must work as we describe it and as you can reasonably expect, for as long as you have access to it. We also keep it up to date where needed so it keeps working.
If something doesn't work, tell us in the app (open the ⋯ menu and choose Report a problem) or by e-mail. We fix it within a reasonable time and without cost to you. If we can't, or the problem is serious, you can ask for a price reduction or end the contract and get your money back for what didn't work. These are your legal rights; for card payments the money is returned through Paddle.
20. Liability
We are responsible for harm we cause by breaking these terms or through our fault, as the law provides. We are not responsible for:
- problems caused by your device, browser, internet connection or other things outside our control,
- losses that weren't caused by us or that neither of us could reasonably foresee when you started using Noiserun.
Nothing in these terms limits our liability where the law doesn't allow it, for example for harm we cause on purpose or through gross negligence, for injury, or under consumer protection law.
Not medical advice. Noiserun helps you relax, focus and sleep. It is not a medical device and doesn't treat any condition. Keep the volume at a comfortable level, especially when you listen for a long time, fall asleep with it, or play it near babies and children.
21. Ending or suspending
You can stop using Noiserun at any time. Cancel subscriptions as described in section 10, and delete your account in the app if you want.
We may suspend or close your account, or end access to Premium, a plan or a code, if:
- you seriously or repeatedly break these terms,
- a payment is not made or is charged back,
- we see a real risk of fraud or of harm to our systems or other people,
- the law requires it.
Unless it is urgent or the law prevents it, we tell you first, explain why and give you a chance to put it right. If we close your account without good reason, we refund what you paid for and can no longer use.
22. Changes to these terms
We may update these terms, for example when we add features, when the law changes or to make them clearer. For important changes, we tell you by e-mail or in the app at least 30 days before they apply. If you don't agree, you can cancel your subscription and stop using Noiserun before the change applies; if a change makes your paid access worse, you get a refund for the time you paid for but won't use. If you keep using Noiserun after the change applies, the new terms apply to you.
The date at the top shows when this version took effect. Earlier versions are listed at the end of this page.
23. Law and disputes
These terms are governed by Slovak law. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you can take a case to the courts there or in Slovakia.
If you are unhappy, please write to us first at hello [at] noiserun.com. We try to solve every problem quickly. If you are a consumer and we don't solve it, you can ask an alternative dispute resolution body for help, such as the Slovak Trade Inspection (Slovenská obchodná inšpekcia). Details are in our Legal notice.
For card payments, Paddle's own terms set how disputes about the payment are handled.
24. Other things
- These terms are written in English.
- If any part of these terms is not valid, the rest still applies.
- We may transfer this agreement to another company that takes over Noiserun. Your rights under these terms stay the same, and we tell you in advance.
- If we don't enforce a right straight away, we can still do it later.
